zagafeur says:

what's with the teddy?

17th Jun 2006, 20:16

clara says:

Charity thing, apparently.I thought you might know more.

17th Jun 2006, 20:20

clara says:

Pleasure! Why does the teddy scare you?

17th Jun 2006, 20:25

zagafeur says:

I've no idea, when I saw him before there was no mention of Teddy, must've happened earlier. Unless it's Tom's latest comfort thing. He's got a pass thing! I bet that was cause he couldn't get in.

Somebody's stolen Paul's arm.

17th Jun 2006, 20:31

zagafeur says:

*must've happened later.

i know what I mean.

17th Jun 2006, 20:34

clara says:

Did you steal his arm,Zagafeur?

17th Jun 2006, 20:36

zagafeur says:

Probably. Sounds like me.

17th Jun 2006, 20:36

zagafeur says:

I've a trauma of Paul, so don't worry. :p

Got to love teddies! I got my best mate a stuffed lion from the pound shop for his 16th. Better than all the attachments of the age any day, no?

17th Jun 2006, 20:39

clara says:

I've still got my old teddy from childhood, his head's loose but his body's still intact.

17th Jun 2006, 20:39

clara says:

I like the way Duncan's twiddling that teddy's ear!

17th Jun 2006, 20:41

zagafeur says:

ooh I want to see that now.

I hated teddies as a kid. Only thing I had any attachment to was a talking massive thing of a lion king character. Still got it, only my four year old sibling's nicked it.

I'm off, gonna try and convince my parents that it's a good idea to stop at the pub and give me a treat. I could really do with a drink.

17th Jun 2006, 20:42

clara says:

Cheerio then, don't do anything we wouldn't.

WOOO BLOOD. :p

what wouldn't you do then, clara? ;)

17th Jun 2006, 22:22

That's a nasty scar on Duncan's arm
must have been quite a bad time he had with that arm.

That came out so well, Clara! I'm impressed. The teddy got in one of my shots too...he's omnipresent...

18th Jun 2006, 13:14

zagafeur says:

Dolls are weird. My siblings love them, I never got the obsession.

RE Dunc's arm - it's his own bloody fault.

18th Jun 2006, 14:18

clara says:

Thank you Polly!

@Zagafeur -maybe it was,when drunk,beware of arm-wrestlers.

18th Jun 2006, 14:31

18th Jun 2006, 21:47

anonymous says:

the teddy is a travelling around the world teddy for charity (NSPCC). Clara can I have your original photo? as the teddy will be auctioned for charity in ayears time and on mine Tom's eyes are kinda closed :(

19th Jun 2006, 18:35

verocs says:

sorry left my name off the pos above...

19th Jun 2006, 18:36

clara says:

May I ask why you want the original-for what purpose?

20th Jun 2006, 09:25

verocs says:

it would be printed off in the teddy photo book and also be on his blog when its ready
as i said before it will be all auctioned for NSPCC in about a years time

20th Jun 2006, 19:48

clara says:

Are you working for the NSPCC then,
as it may be an issue of copyright
- I can't just let you have a copy
without knowing who you are and what's involved,as you must realise.

20th Jun 2006, 21:21

clara says:

I hope you understand. Also you would have to get permission from the Vinyl Factory Gallery,as copyright would be involved as the
photo was taken on their premises.

20th Jun 2006, 21:23

anonymous says:

I didnt think it being this complicated sorry

it's all explained on the kaiser chiefs board in general chat:
teddy's diary and teddy's pictures

it is basically as i said that this teddy is travelling around the world and gets his photo taken at landmarks and famous people. and at the end of his travels he will be auctioned on ebay and proceedings go for NSPCC. it started by a friend of mine and we all help out.

Im on the maximo board too btw
and i did ask the bands permission for posing with the teddy and took one myself too but I thought it would be nice to include yours too.

20th Jun 2006, 23:06

verocs says:

ohh i left it out I dont work for NSPCC it is all a private initiative just wanting to raise some money for a good cause while having fun

20th Jun 2006, 23:08

anonymous says:

stop that at once
no fun allowed

20th Jun 2006, 23:35

clara says:

Yes I see what you're saying Verocs,however I'm not being a
killjoy, but the photo is being used for something else.I'm sorryI can't help!

21st Jun 2006, 09:35

verocs says:

it's allright
btw did you ask permission to photo the teddy? ;)

21st Jun 2006, 10:55

clara says:

To be honest with you,I took the photo so quickly and it was half in light and half in darkness that I didn't see a teddy there, and if I had,I wouldn't have known what it was for!!There were no signs up anywhere about NSPCC teddies. When the photo came out,I was surprised to see the teddy there.

21st Jun 2006, 11:00

clara says:

The man told me I could take photos, but not once did he ever mention a teddy. It could have belonged to one of the band, for all I know!

21st Jun 2006, 11:02

clara says:

Belonged to Duncan,perhaps?

21st Jun 2006, 11:02

verocs says:

it doesnt
the teddy belongs to my friend dave and maximo park was posing with it for my request especially for that cause only I explained before.
I wouldnt fuss so much about it but you want to use that photo for another cause and mentioned permissions...
i need to look into it further and ask what my lawyer friend says

21st Jun 2006, 11:41

Sarah says:

I'm sorry Clara, but that's bollocks, why would we need to ask the Vinyl Factory for permission? It's all for a bit of fun, you're taking this too seriously methinks.

21st Jun 2006, 12:05

clara says:

It's not bollocks,there's something
that exists in this world called
COPYRIGHT and for your information,I'm not using my photo
for another cause. I suggest you
stop asking me for my photo. As I said, the photo was taken on the
Vinyl Factory's premises, so they
have a legal say in it. Is that clear? Why should I have to tell you all the ins and outs of copyright-I'm not taking it too seriously at all,and what you do with your teddy photos is entirely up to you,but I'd rather not get involved.

21st Jun 2006, 19:06

Ding Dong Dave says:

Hey we had permission from band to take pics with our teddy which will be meeting every band under the sun over the next year then autioned for kids. Why be such an ass over it its not like were doing you out of anything you would actually be helping a good cause just by letting us use the pic

21st Jun 2006, 19:21

Ding Dong Dave says:

please check out Kaiser forum and you will see for yourself. Also i think if you read the freedom of information acts you will see unless copyrighted or protected by an official seal anyone can use any picture they wanted. (if not paparazzi would be out of a job) We just thought we would be polite and ask but that obviously dont work.

21st Jun 2006, 19:25

clara says:

I suggest you ask someone else on this blog if you would like to use their pic for your cause.
Matter closed.

21st Jun 2006, 19:28

mat says:

Just to clear up a few things: copyright belongs, automatically and without needing a © mark or anything else, to the person who took the photo, and it's that person's call as to whether their photo gets used elsewhere.

Using an image that belongs to someone else without permission may be illegal - there are some, limited, cases where use is allowed. Charity use may or may not (more likely not) be one of them. I suggest you check with a legal advisor.

The freedom of information act concerns public access to certain documents, it has nothing to do with, and does not infringe on, copyright. Papparazzi or other photographers are only in a job becuase their work is protected by copyright laws.

21st Jun 2006, 19:30

clara says:

Thank you very much Mat,for that clarification. And also if the pics are taken on the premises, doesn't copyright involve said premises?

21st Jun 2006, 19:40

clara says:

Thank you for your help!

21st Jun 2006, 19:49

clara says:

Goodnight all.

21st Jun 2006, 20:35

Carla says:

er - in answer to your last question, Clara, not usually (there might be some issue when there is a logo involved).
I think you are being unneccessarily attached to your copyright (no need to shout about it) - I'm sure that they would have credited you, certainly not attempted to pass off the picture as their own. The key point is that the teddy thing was for a good cause and you were asked nicely. It's sad to see that not all fans of a great band are as nice as the band itself.
(ps - I am a lawyer, but first of all I am a human being and a music lover)

22nd Jun 2006, 08:45

clara says:

Well if you are a lawyer, perhaps you could be more courteous to someone you have never met,and are not likely to (and I don't particularly wish to now I've read
your post.)I find your post insulting in the extreme.

As to my copyright,I have the right to do as I wish with it.
Mat, please sort this out.

22nd Jun 2006, 10:31

clara says:

I don't even know if you are genuine,qualified and/or on the register(LLB,etc.)

I WISH TO RETAIN FULL RIGHTS OVER MY COPYRIGHT.

22nd Jun 2006, 10:32

clara says:

And I'm not saying that the charity WOULD attempt to pass off the picture as their own,I wouldn't trust anyone these days not to copy it and use it for their own purpose.Surely that makes sense. My integrity as a person has nothing to do with this matter. It's called self-protection.

Have a good day!!

22nd Jun 2006, 10:37

clara says:

I think you're exceedingly insulting.

22nd Jun 2006, 10:57

anonymous says:

not nearly as insulting as you though

22nd Jun 2006, 16:00

anonymous says:

Insulting? Has anyone insulted you outright? Is your definition of an insult someone who disagrees with you?

You have not taken copyright out on the photo, therefore there is no legal issue of copyright here.

22nd Jun 2006, 16:06

anonymous says:

If that's the way you want to be though, well you've violated our copyright of the teddy. Therefore you will be expecting a letter from my lawyers.

22nd Jun 2006, 16:09

clara says:

There is copyright out automatically on my pic-I hold it as I took it.Read Mat's post of 7.30pm 21st June-he's explaining it to you.
Mat-hello-this is really pathetic.
I'll see you all later.

22nd Jun 2006, 16:11

anonymous says:

Like I said, you violated our teddy. Dave bought the teddy, henceforth he holds the copyright to it, any pictures taken of it and any uses it is put to.

22nd Jun 2006, 18:55

daz says:

anonymous: Excuse the language, but that's bullshit. But of course you are *well* aware of that, I'm sure.

Keep up Daz, I'm using her argument against her in a highly immature and petty fashion. *rolls eyes*

22nd Jun 2006, 20:50

Yep, that's why I stated that you are well aware of your bullshitting.

She is still right, though. Her picture, her rules.

Matt should get out more.
As for Daz .......
All of you GET A LIFE

22nd Jun 2006, 21:16

daz says:

Oh right, you're the one posting lame anonymous comments because you're not getting your way (teddies, tantrums... someone hasn't gotten past their terrible twos yet, it seems...), and *I*/we need to get a life.. :D

22nd Jun 2006, 22:23

anonymous says:

Actually that's not me. And there are at least 2 anonymous posters. :P

We're just far too scared of what you'll do to us if you find out who we really are.

And by the way, I wasn't attempting to 'bullshit' her, I was being sarcastic for chrimity's sake.

22nd Jun 2006, 23:18

Ding Dong Dave(davidamb-at-aol-dot-com) says:

Pretty easy really as we already have fantastic pics of the band with the teddy so we will stop using your particular picture if you photoshop the teddy out of your pictures. Simple as that really. It belongs to me and i dont want anyone else taking pics of it unless they are part of the team sending this little fella round the world. Thats what makes this unique is that next year there will be a photo diary with the bear and many different bands for auction and all the proceeds will be going to a charity we choose. By posting similar pictures yourself your disrupting our effort and cause. Personally i want you to edit him out of your pics then as he belongs to me and i dont want anyone taking pics other than the people who are part of our effort. Sad thing is we are all also Maximo fans ourselves and didnt really expect such sourness from our fellow board. Youd thiink that if the band were willing to help out on a good thing then so would their forum members but obviously not. Oh and as for the guys defending her corner please dont slag off my post whilst hiding behind your forum name i hate pretend knights in shining armour its pathetic. Clara should you wish to discuss this without all the bickering and deal with it in a civil way them please PM me on the kaiser board.

Im waving a white flag here so come and talk

23rd Jun 2006, 07:30

clara says:

Thank you Daz-I am indebted to you for your generous support.I feel that the matter's closed now and we shall agree to differ. And anyway, there's nothing wrong with your original teddy photo,Verocs.Nothing whatsoever. You could quite well use that for your cause.
Many thanks again,Daz!!xx

23rd Jun 2006, 12:06

clara says:

If you had gone about this NSPCC photo thing in a more professional way in the first place,we could have reached an agreement, however as it stands currently,we must agree to differ.

23rd Jun 2006, 12:10

mat says:

As the site admin, it's my job to step into stuff like this and mediate. I don't appreciate being abused for that, Dave/anon/Teddy, so please keep an eye on your language in future.

If Clara doesn't want her photo used, that's her decision. I'm not "defending her corner" per se, I'm standing up for her becuase the law is on her side, and you guys seemed to be getting confused about the copyright situation.

I can't say for certain, but I suspect that Dave has no right to demand the removal of his teddy from Clara's image. If it was Dave himself in the photo, he would have every right to block publication of the image, but I honestly don't know where the law stands for this situation. My guess would be that people are allowed to take photos of things, meaning Clara doesn't have to do anything. Someone might want to check with a legal professional on that.

My personal opinion is that any exposure of the bear in action ('official' photo or otherwise) is going to help it's cause, so trying to pull photos down just becuase their owner wishes to retain copyright seems somewhat counter-productive. But then if it were my photo originally, I'd have released it for use: becuase getting published (with credit) is nice, and it *is* for charidy after all.

23rd Jun 2006, 16:31

you can't edit your comments if you're not logged in when you make them. :)

Suggest you reboot your browser/computer and try again, that seemed to fix the problem last time.

23rd Jun 2006, 16:44

daz says:

There is thing in German copyright law (I'm sure you guys have some variation of it) that says that a person owns the right of a picture of themselves - not their belongings.

The teddy is an inanimate object and I doubt that statute applies to it. Demanding to edit it out of the picture is just ridiculous. It's not a protected logo or anything. Acting this sulky about it does not exactly make me want to support your "project", either, by the way. As Clara said above, you're not exactly handling the situation professionally.

If you don't want your belongings photographed by people you do not approve of, I suggest you do not subject them to the general public.

Oh, and as for the "hiding behind forum names" thing? We're laying as much out as you do, in my opinion, what with the links in our names leading to our personal pages with nifty "contact user" buttons and the like.

*flings two cents and skips off*

23rd Jun 2006, 21:04

verocs says:

I thought I asked in my first post politely and tried to answer any concerns you had clara about the whole thing. I was a bit taken back when you started to be all accusitive about my motives like i was lying about it. I might be wrong but well thats how i felt anyway.
thats why i became defensive too.
I always try to be nice and polite to anyone but i did feel you accusing me of trying to steal your photo and sell it or something while all i asked for if you want to be included and credited in this great cause.
thats it for me about this whole madness...

24th Jun 2006, 10:38

I'm using a temporary computer at the moment,Mat,thanks for your advice about rebooting-however I've noticed others on here having difficulties logging in. When I get back to my own system next week, normal service will hopefully be resumed.
